These Terms and Conditions for Candidates (“Candidate Terms”) apply to any individual who registers for, or uses, the Candidate features of the SayHello platform (“Platform”), operated by SAY HELLO - FZCO, a company incorporated and registered in the Emirate of Dubai, United Arab Emirates under trade licence number 89628 (“SayHello”, “we”, “us” or “our”) (each, a “Candidate”, “you” or “your”).
These Candidate Terms are supplemental to, and incorporate by reference, our General Terms and Conditions (“General Terms”) and our Privacy Policy, which together with these Candidate Terms form the “Legal Terms” applicable to your use of the Platform as a Candidate. Capitalised terms used but not defined in these Candidate Terms have the meaning given to them in the General Terms. In the event of any conflict or inconsistency between these Candidate Terms and the General Terms on a matter specific to Candidates, these Candidate Terms shall prevail to the extent of the conflict or inconsistency.
1. APPLICATION OF THESE TERMS
1.1 By registering a Candidate Account, completing a Candidate profile, or otherwise accessing the Candidate features of the Platform, you agree to be bound by these Candidate Terms, the General Terms and our Privacy Policy, together the Legal Terms applicable to you.
1.2 We provide a technology platform enabling individuals to create a profile and search, discover and apply for job opportunities, together with related recruitment, matching, communication and support functionality (the “Services”). Save as expressly agreed by us in writing, we are not the employer, a recruitment agent or the decision-maker in respect of any recruitment process, and we do not guarantee any interview, offer or hire arising from use of the Platform.
2. ELIGIBILITY
2.1 By registering as a Candidate, you represent and warrant that you are at least eighteen (18) years of age, or the applicable minimum age of legal capacity to enter into binding contracts in your jurisdiction, and that you are legally entitled to enter into these Candidate Terms.
2.2 By applying for, or expressing interest in, any Job Advertisement, you represent and warrant that you hold, or are eligible to obtain, any visa, work permit, labour card or other authorisation required under UAE law (or the law of the relevant jurisdiction) to lawfully take up the role advertised, and that any information you provide about your right to work is accurate and current. You are solely responsible for verifying and maintaining your own right-to-work status, and we accept no responsibility for any Job Advertisement, interview or offer that does not proceed, or that is withdrawn, as a result of your right-to-work status.
3. CANDIDATE ACCOUNTS
3.1 Candidates may register for an Account free of charge. For creating an Account, Candidates shall have the option of using their Gmail, LinkedIn or similar third-party account, as well as our own registration process. Where a third-party account is used, relevant personal information required to create the Account may be shared with us by that third party.
3.2 Creation of a Candidate Account, or completion of a Candidate profile, does not entitle a Candidate to any guaranteed visibility, response, interview, or offer of employment.
3.3 Candidates are solely responsible for ensuring that all information contained in their profile, CV and any other Candidate Content is accurate, current, truthful and not misleading, and must promptly notify us of, and update their profile to reflect, any change to such information.
3.4 Candidates acknowledge and agree that Employers, and not SayHello, are responsible for reviewing Candidate profiles and making recruitment and employment decisions, and that we do not vet, endorse, verify or guarantee the identity, legitimacy or conduct of any Employer or the accuracy of any Job Advertisement.
3.5 You shall not set up multiple Accounts, and shall not lend, transfer or sell your Account or login credentials (“ID”) to another party, or use another User's Account without their permission. You are solely responsible for keeping your ID and other Account information secure, and we shall have no liability for any unauthorised use of your ID.
4. CANDIDATE CONTENT
4.1 By submitting Candidate Content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format and display such Candidate Content, and to make it available to Employers through the Platform for recruitment purposes, in accordance with our Privacy Policy.
4.2 The general warranties and conduct obligations applicable to Content you Post on the Platform, including in relation to intellectual property rights and third-party consents, are set out in the General Terms and apply equally to Candidate Content.
5. CV ENHANCEMENT SERVICE
5.1 Use of the core Candidate features of the Platform, including creating a profile, uploading a CV, and applying to Job Advertisements, is free of charge to Candidates.
5.2 We may offer Candidates an optional paid service to enhance, format, review, optimise or promote their profile or CV (“CV Enhancement Service”), for the fee displayed on the Platform at the point of purchase.
5.3 The CV Enhancement Service is a formatting, presentation and/or promotional service only. We do not guarantee, and no marketing description of the CV Enhancement Service should be read as guaranteeing, that use of the CV Enhancement Service will result in any interview, shortlisting, job offer, or improved recruitment outcome.
5.4 Payment for the CV Enhancement Service is made through the payment methods made available on the Platform and, once the relevant service has been delivered, is non-refundable, save as required by applicable law.
5.5 All payments made by Candidates through the Platform are subject to validation by the relevant payment processor or card issuer. If payment is declined, we may decline to process or cancel the relevant order.
6. CANDIDATE DATA AND PRIVACY
We will process your personal data, including Candidate Content, only to the extent you have provided it to us, and as further described in our Privacy Policy, which forms part of the Legal Terms. Please review our Privacy Policy for further information on how we collect, use, store and share personal data, including the circumstances in which it is made available to Employers.
7. SUSPENSION AND TERMINATION
7.1 A Candidate may terminate their Account at any time by contacting us at info@SayHelloJobs.com .
7.2 On termination or suspension of a Candidate Account: (a) access to the Platform will cease or be restricted; (b) your Candidate profile and Candidate Content will be closed or removed from active visibility to Employers, subject to our Privacy Policy; and (c) any outstanding fees for the CV Enhancement Service remain payable. We shall not be liable to any Candidate for any loss arising from suspension or termination carried out in accordance with the Legal Terms, and termination shall be without prejudice to any rights or obligations that arose prior to the date of termination.
7.3 The General Terms, including our rights to suspend or terminate an Account for breach of the Legal Terms or applicable law, apply in addition to this Clause 7.
